📋 Terms of Use

1. Acceptance of Terms

By accessing or using Hoppy Highway, you confirm that:

• You have read, understood, and agree to be bound by these Terms.
• You are at least 13 years old, or if you are under 13, you have obtained verifiable parental consent to use the App.
• If you are a parent or guardian allowing a minor to use the App, you agree to these Terms on behalf of the minor and accept full responsibility for their use.
• You comply with all applicable local, national, and international laws and regulations.

We reserve the right to modify these Terms at any time. We will notify users of material changes through in-app notifications or by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. License and App Usage

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes on devices that you own or control.

2.2 License Restrictions

You agree NOT to:

• Copy, modify, create derivative works from, reverse engineer, decompile, or disassemble the App.
• Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App to any third party.
• Remove, alter, or obscure any proprietary notices or labels on the App.
• Use the App for any illegal, harmful, or unauthorized purpose.
• Interfere with or disrupt the App's servers, networks, or security features.
• Use bots, scripts, or automated systems to play the game or gain unfair advantages.
• Exploit bugs, glitches, or errors in the App for personal gain.
• Attempt to access restricted areas of the App or its backend systems.

2.3 Account Responsibility

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

3. Intellectual Property Rights

3.1 Ownership

All intellectual property rights in and to the App, including but not limited to:

• Source code, software, and algorithms
• Graphics, artwork, animations, and visual designs
• Music, sound effects, and audio content
• Characters, names, logos, and trademarks
• Text, content, and documentation
• User interface and user experience designs

...are owned by Hoppy Highway Studio or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

3.2 User Content

Any content you create, upload, or share within the App (such as custom names, scores shared to leaderboards, or feedback) remains your property. However, by submitting content, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content for the purpose of operating and improving the App.

3.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without any obligation to compensate you. We appreciate your input in making Hoppy Highway better!

4. In-App Purchases and Virtual Currency

4.1 Virtual Currency

• Coins, gems, and other virtual currencies have no real-world monetary value.
• Virtual items are licensed, not sold, to you.
• We reserve the right to modify, manage, or discontinue virtual items at any time.
• Virtual currency and items cannot be transferred, sold, or exchanged outside the App.

4.2 Payment Processing

All payments are processed through Google Play's billing system. We do not collect or store your payment information. Please review Google Play's Terms of Service for payment-related terms.

4.3 Refunds

Refund requests must be directed to Google Play according to their refund policy. We do not process refunds directly. In certain jurisdictions, you may have statutory refund rights that cannot be excluded.

5. User Conduct and Community Guidelines

5.1 Prohibited Conduct

When using Hoppy Highway, you agree NOT to:

• Harass, bully, threaten, or intimidate other users.
• Share content that is obscene, pornographic, violent, hateful, or discriminatory.
• Impersonate any person or entity, or misrepresent your affiliation.
• Share personal information of others without consent.
• Use cheats, hacks, mods, or third-party tools to gain unfair advantages.
• Engage in fraud, phishing, or other deceptive practices.
• Spam, advertise, or promote unauthorized products or services.
• Upload viruses, malware, or harmful code.

5.2 Enforcement

We reserve the right to investigate and take appropriate action against violations, including:

• Issuing warnings or temporary suspensions
• Removing offending content
• Resetting scores, progress, or virtual currency
• Permanently banning accounts
• Reporting illegal activity to law enforcement

6. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

Key privacy commitments:

• We comply with COPPA, GDPR, and other applicable privacy laws.
• We do not knowingly collect personal information from children under 13 without parental consent.
• We use non-personalized ads only, in compliance with child safety standards.
• We do not sell your personal data to third parties.

7. Third-Party Services

The App may contain links to or integrate with third-party services, including:

• Google Play Services: For app distribution, in-app purchases, and achievements.
• Google AdMob: For displaying advertisements.
• Google Analytics/Firebase: For analytics and crash reporting.
• Social Media: Optional sharing features.

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

8. Disclaimer of Warranties

We do not warrant that:

• The App will meet your requirements or expectations.
• The App will be uninterrupted, timely, secure, or error-free.
• The results from using the App will be accurate or reliable.
• Any errors in the App will be corrected.
• The App is free of viruses or other harmful components.

You download and use the App at your own discretion and risk. You are solely responsible for any damage to your device or loss of data resulting from use of the App.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Hoppy Highway Studio and its affiliates, officers, employees, agents, and licensors shall NOT be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or goodwill.
• Any damages arising from your access to or use of (or inability to access or use) the App.
• Any conduct or content of any third party on the App.
• Any unauthorized access to or alteration of your transmissions or data.

In no event shall our total liability exceed the amount you paid for the App in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hoppy Highway Studio and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Any content you submit, post, or transmit through the App.

11. Termination

11.1 Termination by You

You may terminate your use of the App at any time by uninstalling it from your device. Simply delete the App through your device's standard uninstall process.

11.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms.
• Fraudulent, abusive, or illegal activity.
• Extended periods of inactivity.
• Discontinuation of the App or services.

Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. However, if you are a consumer in the European Union, mandatory consumer protection laws of your country of residence may apply.

12.2 Dispute Resolution

We encourage you to contact us first to resolve any disputes informally. If a dispute cannot be resolved informally:

• Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions or collective proceedings, to the extent permitted by law.
• Small Claims: Either party may bring qualifying claims in small claims court.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hoppy Highway Studio regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.

15. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Hoppy Highway Studio.

16. Assignment

We may assign or transfer these Terms, in whole or in part, to any third party at our discretion. You may not assign or transfer these Terms without our prior written consent.

By allowing a child under 13 to use Hoppy Highway, parents or guardians:

• Consent to the collection and use of the child's information as described in our Privacy Policy.
• Agree to these Terms on behalf of the child.
• Accept responsibility for monitoring the child's use of the App.
• Understand that the App contains non-personalized advertisements.

19. Google Play Specific Terms

As a Google Play distributed app, the following additional terms apply:

• You agree to Google Play's Terms of Service.
• In-app purchases are processed through Google Play Billing and subject to Google's policies.
• Refund requests must follow Google Play's refund procedures.
• The App complies with Google Play's Developer Policy Center and Families Policy requirements.
• We do not engage in deceptive or manipulative design practices (dark patterns).

20. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last Updated" date.
• Displaying a prominent notice within the App.
• Sending an email notification if you have provided one.

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and uninstall it.
